Knowing what steps to take after a car accident in Michigan can make a huge difference in your ability to recover compensation for your injuries. Once you have undergone medical treatment, filed a police report and obtained the contact information of others involved in the accident, it is time to file a claim with your insurance company.

Before you file your claim, you should understand how the car accident claim process works. You do not want to be surprised by any aspect of the process which could end up harming your claim for damages.

For example, many insurance companies record your conversations with them. If you are unaware that you are being recorded, you may make casual statements that could later sound incriminating. Your words could come back to haunt you if the insurance company tries to use your statements to prove you were responsible for the accident.

First-party and third-party claims

The first step is determining which type of claim to file. A first-party claim is a claim you file with your own insurance company. A third-party claim is a claim you file with another driver’s insurance company.

You may want to file a first-party claim with your own insurance company if you want to claim damages to your car or the other driver is uninsured or underinsured. Remember that you can still file an uninsured or underinsured claim with your policy if your coverage allows.

A first-party claim typically allows you to recover compensation for your initial medical costs and lost wages. However, if you believe the other driver was at fault for the accident, you may want to file a third-party claim to force their insurance company to pay for your compensation.

A third-party claim is also a good idea if your medical costs are significant. If you believe another driver was at fault and your injuries are going to require long-term, costly medical treatment, a third-party claim might be best.

Information you need to file your claim

No matter which type of claim that you file, there is certain information you should have ready when you contact the insurance company. This includes the year, make and model of your vehicle and the names and contact information of yourself and others involved in the accident.

Additionally, have your insurance information ready, including your policy number. Be prepared to provide details about the accident. State when, where and how it happened.

The insurance company will begin an investigation after you file your claim. Common steps in the investigation process include conducting interviews and examining vehicles. If there were passengers in the vehicles, they would likely be interviewed, as will any witnesses to the accident.

The insurance adjuster may want to view photos or videos of your vehicle damage. Document damage to your vehicle at the accident scene and take photos of any injuries immediately after the accident and throughout your medical treatment.

What happens after the investigation

After the investigation is complete, the insurance company will offer you a settlement. There are many factors to consider before deciding to accept an insurance company’s settlement offer.

No one plans to have a car accident and many of us do not handle unexpected events well. In the immediate aftermath of a car accident, it is natural for you to feel scared, confused, overwhelmed and angry.

These emotions are normal and you are allowed to feel and process them. However, they may cause you to say or do things that could hurt your right to hold the other driver accountable for your injuries.

You may know the basic steps to take after a car accident, such as seeking immediate medical treatment, documenting the accident scene and contacting the police. But it is just as important to know what not to do after a car accident.

Do not leave the scene

It is natural to panic and want to get away if you can still drive your vehicle and are worried that you caused the accident.

Leaving the scene not only prevents you from recovering any compensation if you are injured, but you could also face criminal charges.

Do not forget to get detailed information from the other driver. In addition to their name, address and phone number, obtain their driver’s license number, license plate number and car insurance information. Today getting this information is as easy as taking a picture of these items with your phone.

Not seeking medical treatment

Do not assume that you are uninjured or that your injuries are so minor that you do not need to see a doctor. Get checked by a doctor as soon as you can after the accident.

If your injuries are apparent, obtain emergency treatment. Otherwise, see your primary care physician as soon as you can after the accident.

Some injuries are not noticeable right away but can become serious if left untreated. Examples include head injuries, neck injuries or whiplash.

Do not avoid contacting your insurance company after the accident. You need to report the accident to your insurance company to receive accident coverage. The longer you delay reporting the accident, the greater chance your claim will be denied.

Never admit fault for the accident

This means more than declaring that the car accident was your fault or admitting to a traffic violation, such as speeding. A simple apology to the other driver or the police officers who respond to the accident can be viewed as admitting fault.

If you believe the other driver’s negligent driving caused your accident, you can pursue a personal injury claim against them. Negligence is the legal concept personal injury claims are based on.

Not securing help through the process

Making any of the mistakes above could harm your case for negligence. You may be nervous about speaking to insurance companies, particularly the insurance company for the other driver. Insurance companies do not always bargain in good faith.

The time after a car accident can be challenging and complicated while you are recovering from your injuries. It is important to have someone on your side through the process.

Truck accidents in Michigan are often serious, with victims sustaining major injuries, some of which are permanent. Truck accidents are also often responsible for many highway fatalities.

A recent report highlights the number of accidents involving heavy trucks or buses and the causes of the accidents. According to the report, approximately 5.2% of accidents in Michigan involved heavy trucks or buses in 2023.

The report also revealed that turning, backing and lane use errors were more frequent in accidents involving heavy trucks. Truck accidents were found to be more likely to occur on weekdays during the day and involve more than one vehicle.

These statistics show that Michigan drivers should continue to drive carefully around large trucks on the roads and highways and watch for negligent truck driver behavior.

Although a truck driver may sustain injuries in a truck accident, the other party involved often suffers the most serious injuries. The truck’s large size and heavy weight can shield the truck driver from serious injuries.

Staying safe around truck drivers

Drive defensively when you are around trucks on the road. Stay alert and pay attention to the truck’s position on the road. Check your mirrors consistently and be prepared to stop quickly.

Avoid driving too close to trucks if you can. Give them plenty of space around you and do not tailgate.

Truck drivers can engage in aggressive behavior for various reasons such as fatigue, distraction or running behind schedule. They may tailgate you, speed or improperly move between lanes and vehicles.

Slow down and let them pass you. If they are tailgating you, change lanes safely and let them go by.

If they continue to drive near you, pull off the road to a safe place until they are far enough ahead of you. Collect identifying information about the truck or driver and contact the police if you believe they are a danger to others on the road.

What to do after a truck accident

Sometimes despite your best efforts, you cannot avoid a truck accident. You may feel scared and overwhelmed in the aftermath of the accident. Remembering these tips can help you take the proper next steps and increase your chance of holding the party responsible accountable.

Check yourself for injuries and do not move if you believe you are seriously injured. Contact the police and emergency services. Cooperate with emergency services as they treat your injuries.

Talk with the police about what happened and obtain a report. However, be careful about what you say. Do not apologize or say anything that could be viewed as you taking blame for the accident.

Obtain the contact information for the truck driver and trucking company. Talk with any witnesses to the accident and request their contact information.

Take photographs and videos of the accident scene and your injuries. Write down exactly what happened as soon as you can after the accident. You may have trouble recalling details as more time goes by and you are preoccupied with healing from your injuries.

These steps will help you build a strong case against the party responsible, which could be the truck driver, truck manufacturer or trucking company. You must prove negligence to recover compensation, which could include payment for your medical bills, lost wages and pain and suffering.

You’ll likely be hit with extensive pain and limited mobility, your psychological trauma can make it hard to cope on a daily basis and the financial losses thrust upon you can render it hard to make ends meet. With these pressures weighing down on you, it might be tempting to rush through any subsequent legal action to try to obtain closure and compensation as quickly as possible. While it’s true that the vast majority of personal injury cases settle before heading to trial, you need to carefully navigate your settlement negotiations to ensure you’re getting the most out of the process.

But figuring out how to pursue your car accident settlement can be tricky to figure out, especially if you’ve never been in this situation before. We hope that after reading the remainder of this post you’ll have a greater sense of direction so that you can make the informed decisions that are right for you and your future.

Key considerations in car accident settlement negotiations

Before engaging in settlement talks, you need to have a solid game plan. To develop that strategy, you need to consider each of the following:

The value of your claim: You won’t know what settlement amount is appropriate until you’ve calculated all your damages. Therefore, take a holistic look at the harm caused by your accident injuries. While you’ll want to tally your lost wages and medical expenses, you can’t overlook your anticipated medical and rehabilitation costs, and you need clear articulation of your pain and suffering, mental anguish and lost enjoyment of life. All these losses are compensable.

The strength of your evidence: The strength of your case will play a key role in settlement negotiations. If your case is overwhelmingly strong, then you might be able to successfully push for more compensation. If there are weaknesses in your claim, though, such as if you made a mistake that could give way to a comparative fault argument, then you might need to be a little more careful with how aggressively you push for more compensation.

Your willingness to persevere: A personal injury lawsuit can take a while to play out. In the meantime, you may have to turn to savings or family and friends for help covering your bills. But if you feel like you can’t stay afloat that long, or you simply don’t want to deal with the ongoing stress of a pending legal claim, then quicker settlement might be right for you. Carefully think through what you can handle and what you think is right for you.

What you want out of your future: The goal of a personal injury case is to make yourself as whole as possible after being hurt in your wreck. If you want to shield your future as much as possible, then taking your case to trial may be the best way to get the most out of your case if the defense is playing hardball during settlement talks. But, if you’re articulate in your negotiation strategy, then you might still be able to preserve your future through negotiations. Just keep your end goal in mind and figure out which avenue best positions you to attain it.

Develop the personal injury legal strategy that best positions you for success

There’s a lot that goes into a personal injury case. We know the stress of it all can feel overwhelming, but a strong legal strategy should give you some comfort. So, if you’re ready to build a compelling legal claim that seeks to protect your future, then now is the time to start building your case.

It should come as no surprise that there are more drunk drivers on the road over the holiday season between Thanksgiving and New Year’s. Combined with Michigan’s often snowy and icy roads due to winter weather, the holiday roads can be quite dangerous.

Unfortunately, data from the National Highway Transportation Association shows that drunk driving over the holidays has increased in recent years. According to the data, 1,013 people died in drunk driving accidents in December 2021. This is the highest number since 2007.

Avoid becoming a drunk driver yourself

You should never drive after drinking. This is sometimes easier to do during the holidays when there are generally more parties and celebrations than at other times of the year.

If you end up having more drinks than you planned, figure out another way to get home, such as a rideshare or a friend. If you have already started driving, pull over somewhere safe and contact someone to get you home.

Even if you drive sober or stay off the road after drinking, many drunk driving accidents involve one drunk driver and one sober driver. You may be the sober one trying to avoid drunk drivers. Here are some tips to help.

Knowing the higher likelihood that you will encounter a drunk driver on the roads over the holidays means you should place more focus on defensive driving.

How to drive defensively

This means always wearing your seatbelt and following all traffic laws. Maintain a safe distance between vehicles. Since there is a higher chance of encountering a drunk driver, you may want to maintain a father distance than usual.

Pay particular attention at intersections, which is where many drunk driving accidents occur. Take your time going through intersections and yield to oncoming traffic.

Observe other driver’s behavior. Drivers who are swerving or not maintaining consistent speed could be intoxicated. Try to stick to driving on the right side of the road or lane as you face oncoming traffic.

Although sometimes it is unavoidable, try not to drive late at night, particularly on weekend nights, when drunk drivers are more likely to be on the roads.

Do not assume that a driver will do what they should do or follow the traffic laws. If a driver has their right-hand turn signal on, do not assume that they will turn right. Wait until you see what the driver does before you react.

Your rights and options as the victim of a drunk driver

In addition to being criminal, drunk driving is negligent driving. Victims of an accident involving drunk driving often experience serious or life-threatening injuries, which result in astronomical medical bills and lost wages. Pain, suffering and psychological damage are also common in victims of drunk driving accidents.

Michigan law allows you to hold a drunk driver accountable for their negligent actions. A personal injury action allows you to recover compensation for your damages.

Proving negligence requires showing that the drunk driver breached their legal duty to drive safely and this breach caused your accident. You must also prove your damages.

There are several types of evidence that you can use to prove negligence after a drunk driving accident. Knowing how to build a case for negligence increases your chance of recovering full and fair compensation.

But you’re also bound to experience extensive emotional turmoil and the effects of trauma. The impact here can be severe and wide-reaching, too, leaving you with anxiety, depression, irritability, anger, concentration issues, sleep disturbances and mood and personality changes. All of this, in conjunction with the financial struggles that you might face, could leave you completely overwhelmed and uncertain about what your future holds.

But you don’t have to shoulder these burdens on your own, and you shouldn’t try to do so, as that will only amplify what you’re experiencing. Instead, you need to find a way to secure support and ease the turmoil that’s been unfairly thrust upon you.

What are some effective ways to cope with the realities of your car accident?

It may not seem like it right now, but there’s a lot that you can do to ease your physical and mental pain and suffering and spur your recovery forward in a healthy fashion. Here are some tips for doing so:

Ask for help: A lot of car accident victims feel like they’re a burden when they ask their family members and friends for help. But your loved ones want to help you when they can. And if you don’t turn to them, then you’ll be putting more on your plate, perhaps even more than you can handle. So, don’t feel like you’re weak simply because you ask for help, and consider seeking out other assistance, such as mental health treatment and support groups.

Set achievable goals: We know you want to get back to your normal life as quickly as possible, but if you push yourself too hard, then you might fall short of the aggressive goals that you’ve laid out for yourself, which could lead to anger, frustration and despair. These emotions can feed into what you’re already experiencing, which can make you feel worse and fuel any sense of hopelessness that you may be experiencing. So, set realistic and achievable goals for yourself so that you that you can gain momentum in your recovery and can secure a true sense of accomplishment.

Contextualize: As you’re reading this, you might feel like your life is going to be defined by your pain, anguish and limitations moving forward. But this isn’t the case. With hard work, you can and will get through this tough time in your life and find a sense of renewed purpose. You just have to remain positive and focus on the big picture of your recovery.

Take care of yourself: When you’re angry and depressed, it can be tempting to slip into behaviors that are contrary to our best interests. To ensure that your recovery is as strong as possible and that you’re staying as healthy as you can, be sure to get plenty of rest, eat right, exercise if you can and find activities that you enjoy so that you keep your mind engaged and focused on the things that you can still enjoy in life.

Drivers are increasingly distracted, reckless and indifferent to the law and basic safety procedures. That has placed a growing number of people in jeopardy.

Michigan has recently seen a worrisome uptick in riders and pedestrians being hit by automobiles. Those who have been hurt or had a loved one lose their lives must be fully aware of their rights.

Michigan bicyclist and pedestrian crashes the worst since 2019

According to the most recent data, pedestrians and bicyclists saw the highest number of crashes in Michigan since 2019. Comprehensive numbers for 2023 show that there were more than 2,100 auto collisions in which a pedestrian was involved; there were 1,480 such accidents involving a bicyclist. This was a spike of 11% and 10% respectively when compared to 2022. Twenty-four riders lost their lives in 2023; 183 pedestrians were killed.

According to safety professionals in the state, this makes it more important to emphasize to drivers that they need to watch for people with whom they are sharing the road, particularly those who are not protected by an automobile of their own. There were notable decreases in these kinds of accidents in 2019 and 2020 before they started increasing incrementally again. Even areas known to be bicyclist and pedestrian friendly like Ann Arbor saw a worrisome rise in accidents.

The statistics were broken down extensively to highlight when the greatest risk was in terms of days of the week and time of the year. It was safest for riders and pedestrians during weekends. The worst days for crashes were Wednesday and Friday. Autumn saw the most pedestrian accidents with October and November being the worst months. March and July were the safest.

Wayne County had the most bicycle accidents in 2023 with 361. That was up from 294 the previous year. In order, the next four counties with at least one-hundred were Oakland, Kent, Macomb and Washtenaw. Wayne was also at the top for pedestrian accidents with 686.

Navigating the aftermath of pedestrian and bicycle crashes

A person who is injured and the family left behind after a loved one is killed in a bicycle or pedestrian accident will have many questions as to what to do. Since these accidents can be so severe, it can leave a person with massive medical costs, long-term injuries, questions as to how extensive their treatment will be, what their professional prospects are and how their family will move forward.

It is essential to remember that there is no substitute for qualified guidance and a history of helping people in this very situation. A key aspect of any auto accident case is to gather evidence, determine the damage and move forward as soon as possible. People who are concerned about any of these issues after a bicycle or pedestrian accident across the state need to make sure they are protected and hold drivers accountable.

If you watch your neighborhood streets throughout the day, you’re bound to see several delivery trucks zooming from house to house delivering packages.

FedEx, UPS, and Amazon likely send multiple trucks throughout your area on a daily basis. Although these delivery services have made our lives easier in some regard, they also pose a threat to other motorists and pedestrians.

If you’re not careful, then you could end up being seriously harmed in a wreck caused by one of these delivery trucks or vans.

To give you the opportunity to better protect yourself and your loved ones, we want to look at some common causes of delivery truck accidents. With that knowledge, you’ll hopefully be able to avoid these oftentimes devastating collisions.

Common causes of delivery truck accidents

As with other kinds of wrecks, there are several ways that delivery truck accidents can occur. Here are some of the most problematic issues that increase the risk of a delivery truck wreck:

Distracted driving: Delivery drivers have a lot of stops to make on their delivery route. As such, they’re often looking for streets and addresses, and they might have to look known at their navigation device. This distraction takes their eyes off the road and increases the risk of them crossing a center line, blowing past a stop sign, or failing to brake for slowed or stopped traffic. Additionally, delivery drivers are susceptible to other forms of distraction, such as cell phone use.

Erratic driving behaviors: Delivery drivers are on tight timelines, and they want to finish their workday as quickly as possible. As such, they might speed, change lanes without signaling, and turn suddenly and erratically. Any of these driving behaviors can result in a serious accident.

Errant reversing: Maneuvering a delivery truck can be difficult, especially when it needs to be reversed. When a delivery truck driver backs up too quickly or fails to adequately check their surroundings, they can back into another vehicle or strike a pedestrian. Given the sheer size of these vehicles, the resulting damage can be catastrophic.

Poor cargo securement: It’s not uncommon to see delivery trucks driving down neighborhood streets with their doors open. This makes it easier for drivers to access packages from stop-to-stop, but it also increases the chances that packages will fall out of the truck, causing other vehicles to have to swerve to avoid colliding with them. This, in turn, can result in vehicles crashing into each other or pedestrians being struck by vehicles that are trying to avoid hitting fallen boxes.

Bad training: Delivery drivers should be adequately trained so that they can safely operate their trucks. But all too often these companies take shortcuts to ensure they can meet staffing needs. This potentially puts a dangerous and inexperienced driver out on the road where they may not know how to respond to changed traffic and weather conditions. This puts motorists like you in harm’s way.

Have you already been injured by a delivery truck driver?

If you’ve been hurt in a delivery truck accident, then you need to consider taking legal action. That may be the only way to find accountability and recover the compensation you need to offset your losses, the latter of which may include lost wages and medical expenses.

These can be hard-fought cases, though, especially when you’re also suing the driver’s employer, so be sure to gather compelling evidence to support your claim and know how to craft your arguments to the legal elements in play.

The harm caused by these accidents can be extensive, too. You could be left with a head or neck injury that causes extreme limitations to your mobility, and the pain and suffering you experience can be debilitating. In addition, accident injuries can leave you with emotional turmoil and excessive financial losses. These are outcomes you want to avoid.

But what can you do to keep yourself safe from these types of accidents? Let’s take a closer look so that you can protect your well-being as much as possible out on the road.

Steps you can take to reduce the risk of a rear-end collision

It may not seem like it, but there’s actually a lot that you can do to minimize your risk of being injured in a rear-end accident. This includes doing the following:

Keeping a safe following distance: Most rear-end accidents occur when the following vehicle hasn’t given themselves enough space to come to a complete stop when the vehicle in front of them slows or slams on the brakes. Therefore, you can significantly decrease your risk of a rear-end collision by keeping at least three seconds between yourself and the vehicle in front of you.

Staying alert: Awareness is key to avoiding all car accidents. So, eliminate distractions by putting your cellphone away while driving, and be cognizant of the traffic and road conditions around you. The more distractions you can reduce, the better.

Using your mirrors: By regularly checking your mirrors, you become more aware of your surroundings and any pending hazards. This could allow you to slow for any identified risk factors, thereby reducing the risk of being involved in an accident. If a driver tailgates you, then checking your mirrors will let you know that you should move over to let them pass.

Using your signals: If you don’t signal your intentions, then your movements might take other drivers by surprise. You certainly don’t want to do that, as it increases your risk of crashing or being hit by another driver. So, be diligent about using your signal when turning or changing lanes so that you don’t create a rear-end collision.

Following the speed limit: Many rear-end collisions are speed related. Drivers who fail to adhere to the speed limit can struggle to slow and stop for slow or stopped traffic in front of them. To reduce your risk, then, be sure to follow the speed limit and slow down to account for dangerous road conditions, hazards, and slowed traffic.

Having escape routes: If you want to minimize your chances of being involved in an accident, then you need to be as defensive as possible. One way to effectively do this is to plan escape routes and modify them as your surroundings change. If you can do so, then you leave yourself an out when the vehicle in front of you suddenly slams on the brakes.

What should you do if you’ve been involved in an accident caused by someone else?

First, seek medical care. Then, document everything and determine whether the crash was caused by the other driver’s negligence. If it was, then you’re justified in taking legal action against them. And doing so could lead to the recovery of compensation.

After a car accident, you’re bound to be contacted by multiple insurance companies. The representatives from these providers might seem friendly enough, but they aren’t your friend.

You have to be careful in your interactions with them. If you’re not, then you could end up losing out on the compensation you need to offset your losses and position yourself for a successful recovery.

With that in mind, let’s look at the top reasons why you shouldn’t trust an insurance company in the aftermath of your car accident.

Reasons why you shouldn’t trust an insurance company

You might feel like you’re protected by insurance coverage. You’ve diligently paid your premiums over time and now you expect that your insurance company as well as the errant driver’s insurance provider will step in with a helping hand, right?

Well, that may not be the case. Here are some reasons why you shouldn’t be too trusting of the insurance companies that you have to deal with after your car accident:

Their motivations: Despite their marketing that gives the appearance that they’re in the business of helping people, the insurance company is really in the business of making money. The best way for them to do this is to collect premiums and pay out as little as possible in claims. Therefore, they’re going to look for any justifiable reason to diminish the value of your claim or deny it outright. Don’t be tricked by their friendly demeanor.

They’ll try to find inconsistencies: To pay you as little as possible, the insurance company is going to look for inconsistencies in your statements. They might ask for a recorded statement so that they can lock you down on your account of the accident and your injuries, which they’ll then try to contradict and use against you later, perhaps to even show that you’re to blame for the accident. Avoid giving a recorded statement and stick to factual assertions if you have to answer any of the insurance company’s questions.

They’ll minimize your injuries: Even if they appear to feel sorry for you at the outset, the insurance company will seek ways to minimize your claimed injuries. They might ask you to undergo additional evaluations, question your medical records, or even go so far as to surveil you to see if you’re acting in a way that doesn’t align with the severity of your claimed injuries. Make sure you have strong evidence that details the severity and extent of your accident injuries.

They’ll lowball your settlement: The hope is that you can resolve your car accident case quickly while still recovering the compensation you need. But the insurance company will probably try to lowball you during settlement negotiations. Their attorneys will attempt to get you to doubt the strength of your claim, and they might indicate that they’ve only been authorized to pay so much for your case. Don’t give into their sly negotiation tactics.

Protect yourself when seeking compensation after a car accident

You only get one shot at recovering the compensation you need after an accident caused by a negligent driver.

So, before proceeding with your claim, be sure to gather all relevant evidence and anticipate how the process will play out so that you can identify any areas where mistakes could be made.

This foresight will give you an advantage so that you don’t make an avoidable mistake that’s costly to your claim.

We know dealing with the legalities of your situation can be stressful as you’re recovering from your accident injuries, but you can find help navigating the process as you push through to secure the future you want for yourself.
